Terms and Conditions of use of services of Pikakasino - Version 1.1 effective as of 18/09/2020.

1. GENERAL TERMS
1.1. The website Pikakasino.com is operated and managed by Play North® Ltd. (also referred to as "Operator" or the “Company”) and is licensed and regulated by the Malta Gaming Authority in virtue of a Gaming Service class 1 License MGA/B2C/775/2019 issued on 29/04/2020.
1.2. Play North® Ltd. is a limited liability company incorporated in Malta and subject to Maltese law, registration number C86563, having its registered address 7, Triq San Trofimu, Sliema, SLM1119, Malta.
1.3. All payments over the website are managed and collected by the Operator.
1.4. You must read these Terms and Conditions carefully in their entirety before you accept. If you do not agree with any provision of these Terms and Conditions you must not use or continue to use any of the services provided by the Company, Play North® Ltd.

1.6. These Terms and Conditions constitute a binding agreement between You (also referred to as the “Player”) and the Operator, and come into force as soon as you accept the conditions of use of services by clicking "I ACCEPT" at the beginning of your journey with Pikakasino.com. By accepting these terms, you proclaim that you have read and are in absolute agreement of these Terms and Conditions.
1.7. Terms and Conditions apply to all devices.
1.8. These Terms and Conditions are in line with Maltese law and the Malta Gaming Authority. Disputes related to the Terms and Conditions or their infringement shall be resolved in a Maltese court and according to the laws of Malta.
1.9. We reserve the right to modify the Terms and Conditions in the event of legislative changes. Any changes to our Terms & Conditions will be communicated to each individual player upon login and must re-confirm acceptance of Terms and Conditions. Players shall not be allowed to play unless they accept the new Terms & Conditions, but shall be allowed to withdraw their deposits.
1.10. We reserve the right to transfer players information and their contract in the event of sale or merger of the company.
1.11. The customer cannot transfer their contract or their account to another person.
1.12. These Terms & Conditions may be published in several languages, reflecting the same principles, for information purposes and to help players. In case of any discrepancy between the English version and the non-English version of these Terms and Conditions, the English version shall be the prevailing version in the case of conflict.
2. YOUR USER ACCOUNT
2.1. In order for you to play at Pikakasino.com, you are required to register with the site using your personal online banking credentials. Players who have not been identified using bank credentials or the identification fails, are not allowed to play on the site.
2.2. Please be aware that underage gambling is illegal. Age limits for gambling may vary depending on your country of residence. It is your responsibility to be aware of the age limit in your country.
2.3. Players are not allowed to give their banking credentials to another person. Players are personally responsible for all of the activities linked to their account (including transactions). Violation of rules may result in account closure and cancellation of any possible winnings.
2.4. Only one account per customer.
2.5. The Operator may request additional information/documents to verify the player’s identity, such as a copy of your passport, driving license or official ID card. Failure to provide the Company with requested documents, or if the information or documents provided are found false or misleading, your User Account may be blocked or closed and funds forfeited.
2.6. It is your responsibility to check that gambling is legal in your country of residence.
2.7. It is your responsibility to check that you provide correct and valid information during the registration process. Intentionally providing false information will result in account closure and cancellation of any possible winnings.
2.8. By using Pikakasino.com, you confirm that:
- You are at least 18 years old, or older than the minimum age determined by the gambling laws of your country.
- It is your responsibility to know if gaming is legal from the territory in which you are playing.
- You are aware that when playing with real money, you may either win it or lose it.
- You are not using add-ons, cheats or other illegal practices to gain an advantage in the game. We reserve the right to cancel all winnings won through cheating and to close down the account in question.

- The information you have provided is correct and up-to-date.
- Third parties do not have access to your account. Pikakasino is not responsible for any possible account misuse or resulting damages.
2.9. The player must maintain the account details up-to-date.
2.10. Personal data processing and protection:
- Play North® Ltd. keeps your personal information secure and does not disclose it to third parties. If a third party obtains the information through illegal activities, Play North® Ltd. is not responsible for its use.
- If we detect or suspect illegal activity, we may disclose customer information to the corresponding authorities.
2.11. A player account may be closed at the Operator’s discretion, but contractual obligations already made will be honoured by Play North® Ltd. .
2.12. Inactivity and fees:
- An account is considered inactive if the player has not logged in to their account for more than 12 months.
- If a player does not log into their account for more than 12 months, they can be charged a monthly service fee of 5 euros using the funds available in their account.
- The player will be notified of any potential service fees 30 days before they are charged. You can reactivate your account by logging in.
- Account management fees are charged on a monthly basis until the account is reactivated.
2.13. A player can close their account at any time. You can close your account by contacting customer support, via live chat or email. Please withdraw the funds from your account before closing it.
2.14. Use of Pikakasino services is not allowed from the following countries:

2.15. Play North® Ltd. receives the following KYC (Know Your Customer) information with successful deposit from Trustly: first name, last name, date of birth, address and national ID-code. Where data is missing or doesn’t match with the account details, additional documents will be requested. Such documents include but are not limited to proof of identity (passport, driver’s license, national ID-card), proof of address (utility bill not older than 3 months) and proof of payment. Play North® Ltd. also follows anti-money laundering and responsible gaming regulations by checking source of funds/wealth when needed. In such cases additional documents of source of funds/wealth will be requested.
2.16. Play North® Ltd. may obtain information about the player through publicly available sources and databases. We also have the right to ask for the player's proof of identity and address by the latest when the player's cumulative deposits and/or withdrawals reach EUR 2,000. We reserve the right to act at lower levels.
We may block withdrawals and gameplay or even the whole account at our discretion at any time.
Failure to provide correct information or to provide any information requested to enable us to comply with our legal obligations may result in you being reported to the relevant regulatory body.
3. DEPOSIT
3.1. A deposit is necessary before the player can play at Pikakasino.com.
3.2. Deposits can be made only as bank transfer via Trustly. Successful deposits are immediately visible in the player’s account. If the deposit takes longer to reach the account, please contact customer support via live chat or email.
3.3. All deposits are final and cannot be cancelled. It is not possible to request refunds.
3.4. Transactions between players are not possible.
3.5. Play North® Ltd. is not a financial company and cannot offer credit to its customers. Nor do we pay any interest on deposited funds.
3.6. It is not allowed to withdraw funds from the account unless previous deposits are wagered at least once before the withdrawal. If the customer and Play North® Ltd. decide, jointly, that withdrawal is possible before the deposit is wagered at least once, we reserve the right to charge a transfer fee of 10% of the withdrawn amount.
3.7. The minimum and maximum deposit limits depend on the chosen payment method. You can check your deposit limit via the deposit menu in your account.
3.8. We reserve the right to request account and/or payment verification at any time as stated in clause 2.15 above.
3.9. A player may only deposit money using a payment method that is in their own name. If we detect that a player has used another person's payment method, the account will be closed, and its funds will be seized.
3.10. You are only allowed to deposit funds that are legally earned and belong to you. It is unlawful to deposit money from ill-gotten means.
3.11. Play Noth Ltd. may disclose information to government authorities to prevent money laundering and other criminal activities.
3.12. Players understand that the website's services are intended only for entertainment purposes and that the funds are intended only for playing.
4. WITHDRAWAL
4.1. Withdrawals shall only be performed to the same bank account that was used for the original deposit(s). The only available withdrawal method is Trustly bank transfer.
4.2. We reserve the right to close an account temporarily or permanently if account verification fails or if there are problems in the verification process.
4.3. We may contact the player requesting further information or account verification concerning a withdrawal, a deposit or game history.
4.4. To prevent money laundering, the deposit amount must be wagered at least once before withdrawals are permitted. If a player activated a bonus with their deposit, the wager requirement must also be fulfilled before withdrawal.
4.5. We reserve the right to disclose information about suspicious money transfers or other activities to the responsible authorities in order to prevent money laundering.
4.6. In the case of suspicious transactions, information is disclosed to the authorities. We may also close the account and freeze the transactions without disclosing information on the matter in question to the player.
4.7. A withdrawal normally takes five (5) minutes to appear in your bank account, however this may take up to two (2) business days depending on transfer time frame between banks. We are not responsible for potential delays caused by payment service providers.
4.8. If incorrect funds are transferred to a player’s account due to technical or human error, the funds do not become the player’s property, and the player is obliged to inform Pikakasino of the issue immediately. We have the right to correct the mistake.
4.9. If incorrect funds have been transferred to a player's bank account and have been withdrawn, the player is obliged to return the withdrawn funds when requested.
5. RIGHTS AND OBLIGATIONS
5.1. Play North® Ltd. reserves the right to determine game availability as well as add and/or remove games from the website, change bet levels and modify the content of the website at any time.
5.2. Games take place in real time. The bet amount is immediately deducted from the player's account when the round begins, therefore we cannot issue refunds or cancel rounds that have already been played. If the player encounters connection issues during a game round, the round in question would be completed in the game server therefore the bet is deducted from the player's balance and any winnings are added to the balance.
5.3. Pikakasino reserves the right to limit/refuse bets.
5.4. In the event of a system error, the round is cancelled.
5.5. If the outcome of the round cannot be resolved due to a system error, the bet is refunded to the player account.
5.6. If the game bet or outcome is incorrect, we reserve the right to cancel the winnings and bets for that game.
6. RESPONSIBLE GAMING

6.1 Reality Check

A message will be displayed on your screen with details about how long you have been playing, how much you have spent/won and also offer a direct link to your transaction history and present you with the option to resume or exit the game.
6.1.2. At your discretion, these intervals could be changed or feature switched off from the ‘Responsible Gambling section in your account.
6.2 Limits
6.2.1. We offer you the opportunity to apply financial limits to your Pikakasino account. These limits are available to help you control your gambling. You may add and/or edit financial limits related to deposits and losses through the ‘Responsible Gambling’ section in your account or by contacting our customer support via live chat or email.
6.2.2. Should you wish to set limits on wagering we will gladly help you apply this to your account, however such limits can only be set through contacting our customer support via live chat or email.
6.2.3. You may, at your discretion, choose to set a maximum session time during which you will be allowed to stay logged into your account. Once these limits are set, you will automatically be logged out and will not be allowed to continue playing when you reach the pre-set time limit in any one play session.
6.2.4. At any time, you may change or remove your limits on site or by contacting customer support. Increasing limits (allowing to play more) will take effect only after a 24 hours cool off period whereas decreasing your limits will take effect immediately after change.
6.3 Self-Exclusion
6.3.1. You may at any time request that your Gambling Account be self-excluded for a definite or indefinite period of time. Once you self-exclude, you will no longer be permitted to access your account for the period of time chosen.
6.3.2. Definite self-exclusion is an option to close your account only for a period of time. This option is also available from the ‘Responsible Gambling’ section in your account and options are as follows:

- 3 months
- 6 months
- 12 months.
6.3.3. Regardless of the length of your self-exclusion period, once a self-exclusion period terminates, you will be allowed to commence wagering with the Company automatically.
6.3.4. Any self-exclusion, time out or similar action will be valid across all Websites operated by the Play North® Ltd.
7. FRAUD AND ABUSE
7.1. The following activities are strictly prohibited:
- Using payment information or funds that have been stolen, illegally obtained or which do not belong to you.
- Money laundering and other criminal activity.
- Deliberately changing bets to achieve benefits when meeting bonus wagering requirements.
- Actively using bonus money to gain free rounds or levels in a game and then completing rounds with real money after the bonus money has expired or been cancelled, also called ‘bonus parking’.
- Exploiting possible human or technical errors and using automated add-on programmes.
7.2. Play North® Ltd. prohibits player collusion and takes measures to prohibit the use of devices, such as robots, that distort normal game play.
7.3. Play North® Ltd. reserves the right to intervene in fraudulent activity immediately and without notice.
7.4. We are not responsible for any monetary losses that may arise from fraudulent activities.
7.5. We actively seek to prevent money laundering and fraudulent activities.
7.6. We may disclose your information to authorities if we discover or suspect illegal activity.
7.7. Damaging Pikakasino.com with viruses or spam or by other means is strictly prohibited and such action will always be disclosed to the authorities.
7.8. Unauthorised use of Pikakasino content is prohibited.
7.9. Website and server attacks are prohibited.
7.10. We are not responsible for service disruptions, delays, technical issues in a game, the site's improper functioning or data loss due to a virus or service attack.
7.11. It is not possible to sell or transfer an account to another player.
7.12. Players are required to pay all costs and expenses that arise from breaches of these terms.
8. EXCEPTIONAL CIRCUMSTANCES : WEBSITE AND GAMES
8.1. Pikakasino is not responsible for game-related server problems, stoppages, delays or technical malfunctions.
8.2. Pikakasino is in no way responsible for any damages or losses that are claimed or deemed to have occurred when using the site, including but not restricted to delays or interruptions in operations or transfers, data loss, corruption, communication or line error, targeted sabotage or situations caused by a virus.
8.3. In the event of a complete system malfunction, all bets shall be invalidated.
8.4. If a game round starts but fails and cannot be completed due to a system error, the bet will be refunded to the player's account. If the player no longer has an account, the bet will be refunded through other means.
8.5. If the outcome of a round cannot be seen due to a slow Internet connection or other technical faults, the round will be completed on the game server. The bet will be deducted from the player's balance and any winnings added to it automatically. If the round fails and cannot be completed, the bet is refunded to the player's account.
9. INTELLECTUAL PROPERTY RIGHTS
9.1. Play North® Ltd. own the right of animations, avatars, images, background images, other graphics, photographs, video and audio clips, button icons, streaming data and downloadable materials available to you as a player and protected by international copyright law and intellectual property rights. These rights are owned by Play North® Ltd., its affiliates and third-party licensors.
9.2. All product names, company names and logos mentioned or shown on our website are registered trademarks, service marks or trade names.
9.3. None of the material may be copied, distributed, republished, modified, uploaded, posted, or transmitted in any way except for private or personal use, which must have written consent from the Company.

12. DISPUTES
12.1. Complaints can be made by contacting customer support via email on [email protected].
12.2. All demands regarding money transfers must be presented to the company within three (3) months of the original transfer or payment being made, or of the time it should have been made. Otherwise, we reserve the right to ignore the demand at our own discretion.
12.3. If the outcome of a game is different on the user's screen than on the game server, the server's result stands.
12.4. We will keep the customer informed at regular intervals of the progress of the complaint giving an estimation of the time needed to investigate and resolve the complaint. The Operator will use best efforts to resolve a reported matter promptly.
12.5. The outcome of the complaint is to be communicated within 10 days from the date on which the complaint is received, provided that in certain cases this can be extended by a further 10 days.
12.6. A dispute resolution organisation, Pardee Consulta Ltd, is available to all players located in any country or jurisdiction apart from Great Britain, in the event they are unsatisfied with issue resolution by Pikakasino. Pardee Consulta Ltd is a registered company in Malta having its registered office at Victoria Buildings, Triq l-Għenieq, Naxxar, Malta, which acts as an independent and third party alternate dispute resolution (“ADR”) service provider and is duly authorized and eligible to handle customer complaints related to gambling. 12.7. We store all conversations and emails between the company and customers. To resolve disputes, these records may be handed over to the authorities.
13. ACCOUNTABILITY
